Terms of Services

This Terms of Service (TOS) governs the purchase, use, and rights associated with artwork and designs created by me, including collaborations with guest artists. By purchasing, trading, or otherwise engaging with my art, you acknowledge and agree to these terms. Please read them carefully.---❄︎ I. General Rules ❄︎1. Usage Restrictions
✦ Artworks and designs may not be used for any activities involving NFTs, blockchain technology, or AI-related projects.2. Payments
✦ All payments must be made through PayPal invoices and are processed in Euros (€).3. Ownership and Licensing
✦ Purchasing a design grants you a license to use the design, while I retain copyright and intellectual property.
✦ Designs acquired through monetary transactions may be resold by the buyer, while designs obtained through trades, gifts, exchanges or giveaways are not permitted for resale.
✦ Designs must not be resold for a price higher than the original purchase price without any added piece.
✦ Ownership can be transferred via TOYHOUSE4. Refund Policy
✦ Refunds are not allowed for any purchases made directly from me or any guest artists involved.5. Transfer of Ownership
✦ Character ownership and full-resolution files will only be transferred after full payment has been received.6. Violations and Consequences
✦ Violating these Terms of Service may result in being blocked from future transactions and publicly blacklisted.
✦ I reserve the right to revoke ownership if any client violates these terms.---❄︎II. Artist Rights ❄︎1. Intellectual Property and Copyright
✦ As the artist, I retain full copyright and intellectual property rights to all my designs and artworks, even after sale.2. Public Posting Rights
✦ I may post the artwork or designs publicly on my social media, website, portfolio, or other platforms unless explicitly requested otherwise.3. Usage Rights for Promotion
✦ I may use the designs or artworks, including collaborations with guest artists, for merchandise, artbooks, and other promotional content.4. Right to Revoke Ownership
✦ If a client breaches these terms, engages in harassment, scams, theft, chargebacks, or fails to make payments, I reserve the right to ban the client and revoke rights to the design.5. Editing and Modification Rights
✦ Only the current owner may make edits to the purchased design/artwork. Any edits made must be clearly labeled as modifications to the original piece.---❄︎ III. Usage Rights ❄︎1. Personal Use
✦ Owners may use designs for story and lore building, reposting online (with credit), and creating non-commercial merchandise.2. Commercial Use
✦ Any*for-profit activities using my designs require a commercial usage fee, which is separate from the design’s initial purchase price.
✦ Commercial uses include:
- Financial gain (merchandise sales, licensing)
✦ Promotional or advertisements content
✦ Streaming rights
✦ Commercial fees are 1.5x the original price. Ex: A design is 100€, the commercial fee will be 150€. The buyer will pay a total of 250€---❄︎ IV. Payment Plans ❄︎1. Eligibility
✦ Payment plans are available for designs valued at 100€ EUR or more.2. Deposit Requirements
✦ A non-refundable deposit of 20% of the design’s value is required to start a payment plan.3. Payment Deadlines
✦ For designs valued under 500€ EUR, payments must be completed within 2 months.
✦ For designs valued over 500€ EUR, payments must be completed within 3 months.4. Payment Plan Limitations
✦ Clients may only have one active payment plan at a time. Additional requests must wait until any current plan is completed.5. Ownership and Transfer
✦ Full ownership and transfer of unwatermarked files will only occur once all payments are completed.6. Failure to Pay
✦ Incomplete payment plans will forfeit the deposit and result in the cancellation of the transaction.
✦ The date may be pushed back on exceptional request.---By engaging with my services, you acknowledge that you have read, understood, and agreed to these Terms of Service. Violation of any terms may result in revocation of rights and restricted access to future work.

Commissions[open]

General✦ All prices are listed in Euros (€).
✦ The price range covers varying levels of design complexity.
✦ Prices listed are for personal use only; for commercial fees, please refer to my Terms of Service.
✦ Full or partial payment is required after approval of the initial sketch.
✦ Commissions typically take 1-3 weeks, depending on the design's complexity and my workload.
✦ I reserve the right to decline any commission request that I feel unable to fulfill.---Rush Fee✦ +30%-100% of the total commission price depending on the date.
✦ This will place your commission above all other requests in my queue.---✨ Please Do:
- ✅ Give credit when sharing the design or using it for personal/commercial purposes.
- ✅ Enjoy the design! Use it for personal projects, stories, or commercial purposes (if commercial rights were purchased).
- ✅ Consult me for any major edits or redesigns—I'm happy to discuss adjustments if needed!
- ✅ Feel free to tweak the character's story or personality—make it your own while respecting the visual integrity.
- ✅ Ask for clarification if you're unsure about usage rights or terms.

🚫 Please Do Not:
- ❌ Edit the design significantly without consulting me first. Minor changes (e.g., accessories, hair length) are okay if clearly noted, but the core design must remain intact.
- ❌ Claim the design as your own creation.
- ❌ Use the design for NFTs, AI training, or similar purposes.
- ❌ Resell the design for a higher price than it was purchased for, unless significant additional art has been added to increase its value.---Including this in your Terms of Service or alongside your character design listings will help set clear expectations for your clients.
